THE ROLE OF THE ITALIAN NOTARY

The notary in Italy

The notary in Italy is a public official that represents the State and an experienced professional in the legal field at the same time.

He is appointed by the Ministry of Justice and assigned to a specific municipality. However, if required, the notary can perform his duties in the whole territory of the District of the Court of Appeals in which his assignment is addressed, as long as he will always serve his first mission for at least three days a week.

Although he is therefore "physically" anchored to its area of jurisdiction, while remaining in the original assigned office, any notary can exercise his duties in relation to properties placed anywhere on national territory without limitation (e.g. The parties involved in selling a property located in Palermo can still go to a notary in Turin to sign the contract).

The choice of a notary is absolutely free and at the discretion of the parties: however, in case of real estate transactions the choice of the notary usually appertains to the buyer who is also responsible for the remuneration of the notary, unless otherwise agreed.
